- ItemReview on marital rape Vis-A-Viz the customary practice in Uganda" Case study in Kampala.(Kampala International University, School of Law, 2016-06) Apidra Asaba, SimonThis study under took to identify the causes, types and legal frame work towards marital rape. The main objectives to show whether marital rape can be accommodated in customary practices in Uganda, to explain the importance of including marital rape in penal provisions in society, to expose or show the effect of marital rape on victims, families and society as a whole, and to show the negative side of many myths and stereotypes surrounding marital rape. The methods used in the study involved both literature and face to face interactions with the respondents. Accordingly, the research findings indicate various challenges facing married spouses and children as the most vulnerable to marital rape effects. The challenges are partly attributed to the lack of a precise law on marital rape, the economic disfranchisement of women, the poor attitude held by police officers and religious leaders towards marital rape. To solve the problems hitherto outlined the research found the need to criminalize marital rape, the inaugurations of rehabilitation centers and the sensitization of men in their work places against the act of marital rape. The research also recommended the need for the justice law and order sector to recognize marital rape as any other criminal offence in an effort to combat the wide spread levels of marital rape.
