    The legal and institutional framework regulating the custody of children vis-a-vis the welfare principle in Uganda: a case study of Kampala district

    This study aimed at finding out the legal and institutional frameworks that regulate custody of children in Uganda. It was conducted at Sanyu babies' home using a descriptive design and took a period of one month. The study methodology entailed a review of Children Act and institutional policy guidelines at Sanyu babies' home and an interview with the officer in charge of children welfare; it also reviewed the Adoptive Couple V. Baby girl and Baby Richard cases. The study found out that at Sanyu babies' home the institution immediately assumes full responsibility of children after being introduced by concerned individuals and that the authorities are notified when the children are ahead being cared for. The study recommends that the government of Uganda should relax the requirements for adoption and custody of children so that adults are able to be granted custody of children of opposite sex on condition that there is none of the same sex as a child willing to adopt the child.
