These violations are held both at school level and national level, and their impacts on the academic performance of students are credibly serious. In most studies, the effects of school, teacher, student and parent level factors on student achievement have been given more attention. However, the state, as in the case in Eritrea, as duty bearer and primary protector of the right to education, should be also viewed to affect the academic performances of students at national level. Students were deprived of their rights to available, accessible, acceptable and adaptable education provision in the country. Students of 12th year class were adversely affected their general aUitudes, emotions and focuses towards their study systematically within school environment, which in return triggered to poor academic performances. The major reason for all these educational crimes committed by state government is the lack of good governances in the country. This conclusion came to reality through the use of both case studies approach backed by narrative and descriptive analysis of data collected through primary and secondary sources, with the former receiving the pride of the study. Research instruments were administered to collect primary source data through questionnaire, an in-depth Interview, and focus group discussion. The study made use of secondary sources of data mainly from various internet websites, and printed documents.
