Abstract
The study is founded on the theme of state sovereignty under international law reflected in Article 2(7) of the United Nations Chm1er 1945 (UN) that which is a right of every state to preserve it's on identity m1d unique features like a permanent population, government, defined tenitory and capacity to enter into relations with other states. The paper will show the relevance of state sovereignty under international law and the need for respecting each state's sovereignty.
Article 1 of the UN Cha11er stipulates the purpose for the United Nations to maintain international peace and security deriving mandate to take effective collective measures in order to achieve this international objective. Thus, the legality of interventions on humanitarian ground carried out by the UN in the affairs of Libya regardless of its sovereignty as a state. However, this mandate shall be examined in the research paper pm1raying the violation of state sovereignty through the interference carried out by the UN in the domestic affairs of Libya. More to that, this paper seeks to expose the outcome of interventions by the UN both positive and negative effects.
To what end should the UN interfere with state sovereignty and at what cost? As a result, the once "crown jewel" of Africa that is to say Libya, has been viewing as a failed state with perpetual conflict and instability of its movement. More to that, the research paper shall analyze the role of the international community in respecting state sovereignty alongside the UN intervention in Libya. The research paper aims at painting a clear picture on the aftermath of the
UN intervention in Libya focusing on the failures attributed to Libya's sovereignty that needs redemption hence, the rationale of the research paper. The paper shall also compare similar experiences of other African countries with that of Libya focusing on the impact Libya's situation had on these states while having a specific objective to determine solutions and recommendations to the problem at hand by reconciling the resolutions passed and observing literature review. The method of data collection shall be desk research.
