dc.description.abstractInternational legal instruments and developed theories have made the ascertainment of commencement of belligerent occupation fairly if not sufficiently clear. These rendered denial arguments less likely or untenable in situations where the requirements or criteria exist. The instruments equally provided for the rights of the occupying and occupied powers and those of the occupied population. The article explains in the concept of belligerent under international humanitarian law including the history of the concepts.en_US
