Abstract
The study assessed the protection/observance of right to a clean and healthy environment in Namanve industrial area Uganda. It therefore expressed concern on examination of what is entailed in observance of the right to a clean and Healthy Environment in Uganda, assessed the challenges involved in enforcing a right to a clean healthy Environment, examined the legal, institutional and policy framework of a right to clean and healthy Environment and also provided for conclusions and recommendations. The study used a qualitative methodology to collect both primary and secondary information. Primary sources are legal instruments on environmental protection which included the 1995 Constitution of the Republic of Uganda), the National Environment Management Authority, 2003, Guidelines for Public hearings in Uganda, the Republic of Uganda, 1995 National Policy for the Conservation and Management of Wetland Resources, Wild Life Act 8.46, 66 to 68 and the National Environment Act, Cap 153. Secondary sources of information also used books, journal articles and electronic databases. The study recommended government to continue implementing measures to achieve the new standards for ground-level ozone, striving to take an integrated approach to control ozone precursors at airshed level; develop and implement secondary ambient air quality standards aimed at ecosystem protection for example for ozone. The government should reconcile water quality and quantity objectives, in particular by applying an ecosystem approach to flood control; ensure that flood plain management concerns are systematically taken into account in land use and water policy decisions.
